1 Acceptance of Terms

By accessing or using the website, services, or mortgage brokerage services provided by Blackwood Mortgage, operated by licensed Mortgage Loan Originator Elmer Salazar (NMLS #1599947) ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

These Terms apply to all visitors, users, and others who access or use our website or services, including submitting a mortgage inquiry, application, or any other request for service.

2 Description of Services

Blackwood Mortgage is a licensed mortgage brokerage firm operating in the State of Texas. We act as an intermediary between borrowers and licensed mortgage lenders. We do not fund loans directly. Our services include:

  • Accepting and reviewing mortgage loan inquiries and applications
  • Presenting loan options from our network of wholesale lenders
  • Facilitating the mortgage application and approval process for the following loan types:
    • FHA Loans (Federal Housing Administration)
    • First-Time Homebuyer Programs
    • Conventional Loans
    • VA Loans (U.S. Department of Veterans Affairs)
    • HELOC (Home Equity Line of Credit)
    • Reverse Mortgages (HECM)
    • DSCR Loans (Debt Service Coverage Ratio / Investor Loans)
    • Investor / Non-QM Loan Products
  • Communicating with you via phone, SMS, and email regarding your inquiry or application

We do not guarantee loan approval, specific interest rates, or loan terms. All loan decisions are made by the lender, not by us.

3 Eligibility

By using our services, you represent and warrant that:

  • You are at least 18 years of age
  • You are a legal resident or citizen of the United States
  • You have the legal capacity to enter into a binding agreement
  • You are using our services for lawful purposes only

We reserve the right to refuse service to anyone for any reason at any time, consistent with applicable law.

4 No Guarantee of Loan Approval

Submitting an inquiry or application through our website or by any other means does not constitute a loan approval, commitment to lend, or guarantee of any specific rate or terms. All mortgage applications are subject to full underwriting review and lender approval.

Interest rates, loan programs, and eligibility requirements are subject to change without notice and may vary based on creditworthiness, property type, loan amount, and other factors.

5 TCPA Consent & Electronic Communications

a) Consent to Contact

By submitting your contact information through our website, inquiry forms, or any other channel, you expressly consent to be contacted by us and our authorized representatives via:

  • Telephone calls, including autodialed or pre-recorded calls
  • SMS/text messages, including automated text messages
  • Email communications

This consent applies even if your number is on a federal, state, or local Do Not Call registry. You are not required to provide this consent as a condition of purchasing any property, goods, or services.

b) Opting Out

6 Accuracy of Information

You agree to provide accurate, current, and complete information when submitting any inquiry, application, or other request. Providing false, misleading, or incomplete information may result in denial of services, rescission of any loan offer, and potential legal liability.

You are responsible for updating your information if it changes during the course of our engagement.

7 Fees & Compensation Disclosure

Blackwood Mortgage may receive compensation from lenders in connection with mortgage loans facilitated through our brokerage. This compensation may affect the loan products and rates we present to you. We are required by law to disclose our compensation in your Loan Estimate and Closing Disclosure documents.

We do not charge upfront application fees unless separately disclosed and agreed upon in writing.

8 Third-Party Services & Links

Our website may contain links to third-party websites, lender portals, or external resources. These links are provided for convenience only. We are not responsible for the content, accuracy, or privacy practices of any third-party sites.

We may use third-party service providers (including CRM platforms, marketing tools, and communication services) to operate our business. These providers are bound by their own terms and are contractually restricted from using your information for unauthorized purposes.

9 Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Blackwood Mortgage or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written consent.

10 Disclaimer of Warranties

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount of fees, if any, paid by you to us in the six (6) months preceding the claim.

You agree to indemnify, defend, and hold harmless Blackwood Mortgage and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of another.

13 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or our services shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with venue in Harris County, Texas, except where prohibited by applicable law.

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

We operate in compliance with all applicable federal and state mortgage lending laws, including but not limited to:

  • Real Estate Settlement Procedures Act (RESPA)
  • Truth in Lending Act (TILA) and Regulation Z
  • Equal Credit Opportunity Act (ECOA)
  • Fair Housing Act (FHA)
  • Telephone Consumer Protection Act (TCPA)
  • Gramm-Leach-Bliley Act (GLBA)
  • Texas Finance Code, Title 3 (Subtitle E – Mortgage Bankers and Mortgage Brokers)
  • Texas Secure and Fair Enforcement for Mortgage Licensing Act (Texas SAFE Act), Tex. Fin. Code §§ 180.001 et seq.
  • Texas Data Privacy and Security Act (TDPSA), Tex. Bus. & Com. Code §§ 541.001 et seq.

16 Termination
